• The legal foundations of data protection are regulated in the EU Basic Data Protection Regulation (hereinafter referred to as DSGVO). The operator handles the protection of data and its security responsibly and complies with the statutory provisions:

• By successfully entering the personal data of the user or provider in the registration process, the user or provider agrees that the operator may collect, process and use the data in accordance with the provisions listed here and to fulfill the contract.

Purpose of data collection and processing

• Personal data is data relating to an identified or identifiable natural person. A natural person is identifiable if it can be identified directly or indirectly. • For a provider to be displayed in the search function and to receive a contact request from the user, it is necessary that a successful registration with the above personal data has taken place. In order to guarantee a successful search function, it is necessary that the provider's profile is filled with these additional details in addition to the above data: upload of a photo, details of the time of availability, further details of interest. The provider can change and delete these data independently at any time.

• If a user or provider is successfully registered on silversitting.com, he or she agrees that the personal data entered will be displayed to other logged in members of the platform for contact purposes and that users can contact you using their released contact data. The legal basis is Art 6 I S 1 lit a DSGVO.

• If the membership of the user or the user contract of the provider ends, his profile with all entered data and uploaded files will be completely and irretrievably deleted. • The operator has no influence on the duration of the processing of cookies set by third parties and their storage of IP addresses.

• If the user or provider contacts the operator via silversitting.com (contact form), the transmitted personal data will be processed (e.g. first and last name, e-mail address). These data are used exclusively for the answer of the contact in the context of the inquiry of the user and/or offerer over the contact form. This data will not be passed on to third parties or used for other purposes than those mentioned. • The storage period of all other data provided by the user or provider is based on the processing time required for the request, unless this data is subject to longer tax and commercial retention periods. In any case, the data will be stored until the end of statutory limitation periods for claims for damages.

• The uploaded extended criminal record is then deleted after the positive assessment.

• The user or provider has the right, within the framework of the DSGVO, to request information free of charge on the personal data stored by the operator.

• The user or provider has the right to complain to the data protection supervisory authority responsible for the operator in justified cases (Art. 77 DSGVO).

• According to Art. 7 para. 3 DSGVO, the user or provider is entitled to revoke his consent to the collection and storage of his personal data by silversitting.com. Such a revocation can be asserted by e-mail to info@silversitting.com . Data acquisition on silversitting.com by integration of services and contents of third parties

• The operator integrates services of other companies within the digital platform in order to make the online offer more attractive for the user or provider and to continuously optimise it (legal basis is Art. 6 Para. 1 Sentence 1 a, f DSGVO).

• The transfer of all personal data to the third-party providers listed below is based on Art. 6 Para. 1 lit. a DSGVO (consent) and Art. 6 Para. 1 lit. b DSGVO (processing to fulfill a contract).

•  In the event that personal data is transferred to the USA, the third parties listed below have submitted to the EU-US Privacy Shield. In this agreement, the US Department of Commerce regulates the collection, use and storage of personal data and all EU member states undertake to comply with it.

• The user or provider has the possibility to revoke consent to data processing at any time. A revocation has no effect on the effectiveness of past data processing operations. However, revocation will have the consequence that basic services, which involve the fulfilment of the user contract, cannot be fulfilled. A termination of the user contract between operator and user or provider would thus be the consequence.

• Stripe meets the strictest security requirements: It is certified as a PCI Level 1 Service Provider and encrypts the transmission of data via SSL. This makes it a trustworthy processing partner for the operator. 

• All user data for payment processing is not stored temporarily on the operator's server, but sent securely and directly to Stripe. The operator thus complies with the security standards for processing credit card transactions (PCI) and increases them, since a possible attack on the operator's server would not cause any loss of credit card data.

•  Google Analytics can be used to create analyses of user behaviour. On the basis of this analysis it is possible to optimize the website creation or the online offer for the user or provider.

• Google Analytics uses cookies. The information generated by the cookie (user recognition by user ID, advertising ID by DoubleClick cookies, Android advertising ID cookies) is transferred to a Google server in the USA and stored there.

• The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 para. 1 lit. f DSGVO. The data will be deleted after 26 months.

SendGrid Inc.

• The operator uses the service SendGrid, Inc., 1801 California Street, Suite 500 Denver, Colorado 80202 to transfer personal data (first name, last name, e-mail address) to a server based in the USA. • The operator uses the e-mail address of the user or provider to send e-mails via SendGrid, with the purpose of informing the user or provider about the successful registration, to confirm the e-mail address or to send reminders of pending evaluations.

Braintree

• The operator uses the service Braintree - a Paypal service, 222 W Merchandise Mart Plaza, Suite 800, Chicago, IL 60654.

• Braintree enables the processing of payments via Paypal.

• If the operator processes the personal data in order to carry out direct advertising, the user or provider has the right to object to the processing of the personal data for the purpose of such advertising at any time without giving reasons (Art. 21 DSGVO).
